US Ct of Appeals for 9th Circuit denies on July 27 defense effort to block Pentagon papers trial until Justice Dept discloses details of wiretap incident involving defense; defense attys rept they will seek to obtain further stay from Sup Ct Justice Douglas in effort to take issue to Sup Ct; Douglas says he will hear arguments from defense and Govt atty on July 28; says at that time he will consider whether to stay trial; panel of Judges C M Merrill, M O Koelsch and O M Trask, in unsigned opinion, rules unanimously that defendants Ellsberg and Russo are not entitled to see transcript of phone conversation involving undisclosed defense atty or consultant; says Const's guarantee of effective legal counsel docs not 'confer standing upon a client to pry into all his atty's business, whether it relates to his case or not'; says defendant cannot see such a transcript unless conversation involves client's relationship with overheard person, and that trial judge might determine that conversation docs not involve such a relationship by looking at transcript in secret; Appeals Ct upholds decision by Judge Byrne, who said phone conversation had nothing to do with Pentagon papers case

Assoc Justice Douglas, in his decision whether to delay Pentagon papers trial until wiretap controversy is resolved, says on July 28 that a Justice normally grants stay only if he thinks 'there are 4 votes on the Ct to hear a case,' enough to grant rev; Govt atty D R Nissen says that wiretap is foreign intelligence' device installed on authority of Atty Gen without ct warrant; says it was placed on phone by someone not involved in case who phoned member of defense but did not discuss case; Douglas says Sup Ct does not hold that warrantless wiretaps are legal 'because some foreigner is involved'
